New law on time registration
On July 1st 2024, a new law on time recording will come into force, making it mandatory for all companies to introduce a system to record the individual employee's daily working hours.
Brief about the law
The bill stems from an EU judgement, the "Deutsche Bank" case, from 2019, where it was decided that EU member states must require employers to use a system that can document whether working time rules are observed.
- The system must be able to measure daily and weekly working time
- The system must be objective, reliable and accessible
- Employees must have access to registrations
- The information must be archived for up to 5 years
Deutsche Bank was sued by the Spanish trade union CCOO because they could not ensure that working time rules were respected. The law is thus introduced to make it easier to protect employees' rights - the 48-hour rule, the 11-hour rule and one day off per week - and not to monitor employees.
On 23 January 2024, the bill was considered and adopted in the Danish Parliament.
What must be registered?
The legal requirement requires that employees' daily working hours must be recorded if they differ from the agreed working hours. This means that only deviations from the planned working hours really need to be recorded. The time when the work is carried out is therefore irrelevant. A deviation can, however, be that more or fewer hours are worked than agreed. Therefore, it will often not be enough to only register when the employee works more than the agreed working hours.
Can working hours be recorded in an order system?
